During the last 25 years he has testified for both plaintiffs and defendants and written over 150 expert medical reports. Since 2004 he has testified at trial and deposition more than 13 times. His expert opinions are based on sound scientific principles, evidence based medicine and his more than 30 years’ experience as a physician in private practice. The quality of his reports has helped his clients settle numerous cases and avoid the additional costs of a trial. He has never failed a Daubert challenge.
New cases are evaluated as expeditiously as possible and he maintains good communications with his clients.
Dr. Accetta has worked as a medical review physician for one of Massachusetts’s largest health insurance company and as a physician auditor for a publicly traded medical appeal company.
He has testified in two cases involving alleged pharmaceutical patent infringement.
Dr. Accetta’s interest in occupational and environmental medicine began during his allergy & immunology fellowship at the Cleveland Clinic when he was a member of a team conducting a site visit at a large steel manufacturing facility in Cleveland, Ohio. In the early 1990s, he evaluated a number of health care workers at a major Boston area teaching hospital who alleged that they had developed a variety of medical conditions including asthma, latex allergy, sinusitis and multiple chemical sensitivity due to poor indoor air quality. In one of these cases in which Dr. Accetta was the defense expert (Theresa Canavan’s Case) the Massachusetts Supreme Court overruled a verdict for the plaintiff and adopted in part the United States Supreme Court's reasoning in Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993) regarding the admissibility of an expert’s testimony.

Testimonials

Donald Accetta

Dr. Accetta testified for us in a federal real estate dispute that involved significant water intrusion and mold. He was responsive throughout the litigation process, able to provide helpful insights and suggestions, and very credible on the stand. Dr. Accetta was also able to explain the impacts of mold exposure in a way that made the concepts easily accessible to the jury. We enjoyed working with him.
